Welcome to VidGlow ("VidGlow", "we", "our", or "us").
These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and any related products, features, content, and services (collectively, the "Services").
Please read these Terms carefully before using the Services.
By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.
If any provision of these Terms is determined to be unenforceable under applicable law, the remaining provisions will remain in full force and effect.
If there is any inconsistency between a translated version of these Terms and the English version, the English version will prevail to the extent permitted by applicable law.
1. Changes to the Terms and the Service
l Updates to Terms: We reserve the right to modify or update these Terms at any time in our sole discretion to reflect changes to our Service, legal or regulatory compliance, or business operational needs. When material changes are made, we will notify you through reasonable means, such as updating the “Last Updated” date above, sending an email to your registered address, or displaying an in-App banner/push notification. Revised Terms take effect immediately upon posting unless specified otherwise. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree, you must immediately discontinue use and delete the App.
l Service Modifications: We reserve the right to update, modify, suspend, or discontinue any aspect, feature, or content of the Service at any time without prior notice or liability. Certain features or services may not be available in all countries, languages, or operating systems.
2. Eligibility & Legal Authority
The Service is intended exclusively for individuals aged 18 years or older.
l Minors: If you are between the age of 18 and the legal age of majority in your jurisdiction, your parent or legal guardian must review and agree to these Terms on your behalf, and supervise your use of the Service.
l Restrictions: You are strictly prohibited from accessing or using the Service if:
1.You do not agree to be bound by these Terms;
2.You lack the legal capacity or parental consent to enter into a binding agreement; or
3.Applicable laws, regulations, or trade restrictions prohibit your access to or use of the Service.
3. Prohibited Uses & Community Guidelines
You agree to use the Service responsibly and lawfully. You shall not—and shall not permit or assist any third party to:
l Use the Service for any unlawful, fraudulent, deceptive, or unauthorized purpose;
l Import, upload, generate, or transmit content that is illegal, defamatory, abusive, obscene, threatening, hateful, violent, harassing, discriminatory, or sexually explicit;
l Infringe, misappropriate, or violate the intellectual property, privacy, publicity, or proprietary rights of any person or entity;
l Copy, frame, mirror, modify, adapt, or create derivative works of the Service without our express written consent;
l Interfere with, disrupt, or impair the security, integrity, or performance of the Service, its underlying networks, or server infrastructure;
l Use automated scripts, spiders, crawlers, data mining, or scraping tools to extract data from the Service without authorization;
l Circumvent, disable, bypass, or tamper with any digital rights management (DRM), authentication, content filtering, or security features implemented in the Service.
4. Intellectual Property Rights
l VidGlow Property: VidGlow and its licensors retain all right, title, and interest (including all intellectual property rights) in and to the Service, including software, algorithms, user interfaces, branding, graphics, media, and text provided by us (excluding User-Generated Content).
l Limited License: Subject to your compliance with these Terms, VidGlow grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service solely for your personal, non-commercial purposes. All rights not expressly granted herein are strictly reserved by VidGlow.
5. User-Generated Content (UGC) & Feedback
l Ownership: You retain full ownership of any text, images, video, audio, or other materials you submit, upload, create, or process through the Service ("User-Generated Content" or "UGC").
l License Grant: To enable us to operate, provide, and secure the Service, you grant VidGlow a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, and modify your UGC solely for operating, delivering, maintaining, and improving the Service.
l AI Training Notice: We will not use your UGC to train or fine-tune machine learning or AI models without your prior explicit consent, in accordance with our Privacy Policy.
l User Representations: You represent and warrant that you own or have obtained all necessary licenses, permissions, and rights to upload and process your UGC without violating third-party rights or applicable laws.
l Feedback: If you provide suggestions, feature requests, or comments ("Feedback"), you agree that VidGlow may freely use and implement such Feedback without restriction, compensation, or obligation to you.
6. Generative AI Features & Safety Rules
The Service includes tools powered by artificial intelligence ("Generative AI Features") that allow you to submit text, images, or media ("Input") and generate new content ("Output"). As between you and VidGlow, Input and Output are treated as UGC.
When using Generative AI Features, you strictly agree NOT to generate, upload, or distribute:
l Child Exploitation: Child Sexual Abuse Material (CSAM) or any content that exploits, harms, or sexualizes minors;
l Sexually Explicit Content: Pornography, explicit sexual imagery, or non-consensual intimate imagery;
l Harmful / Dangerous Activities: Malware, phishing content, actionable guides on illegal acts, or attempts to "jailbreak" or bypass AI safety filters;
l Hate & Violence: Content that incites violence, promotes terrorism, or discriminates against individuals or protected groups;
l Deceptive Content: Deepfakes, fraudulent impersonations, or misinformation intended to mislead or harm others.
Disclaimer on AI Output: AI technologies generate content probabilistically. Output may occasionally be inaccurate, incomplete, or repetitive. You are solely responsible for reviewing and verifying all AI Output prior to reliance or publication.
7. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
VIDGLOW EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE OR ANY AI-GENERATED OUTPUT WILL BE ACCURATE, SECURE, RELIABLE, OR FREE FROM VIRUSES OR DEFECTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
8. Purchase & Refund Policy
l In-App Purchases (iOS / App Store): Purchases processed through Apple's App Store are subject to Apple’s payment, billing, and subscription terms. VidGlow does not store your payment card information and cannot directly process, approve, or issue refunds for App Store purchases. Refund requests for iOS in-app purchases must be submitted directly to Apple Support.
l Direct Digital Products & Services: For purchases made directly through our website or authorized platforms (including credit packages, digital assets, or direct subscriptions):
¡ Digital Nature: Because our services provide instant digital assets (AI generation credits, processed videos, etc.), returns are generally not applicable once delivered.
¡ Eligibility for Refunds: Refunds may be evaluated and granted if:
1.A verified technical system failure prevented successful delivery of the service;
2.Purchased credits or subscription features were never activated or consumed; or
3.Duplicate charges occurred due to a technical payment processor error.
¡ Non-Refundable Circumstances: Refunds will not be granted for personal dissatisfaction with AI creative outputs, user error, device incompatibility, or account suspension resulting from Terms violations.
9. Account Suspension & Termination
l By You: You may stop using the Service at any time by deleting your account and removing the Apps from your devices.
l By VidGlow: We reserve the right to suspend, restrict, or terminate your access to the Service immediately, without prior notice or liability, if:
1.You commit a material or repeated violation of these Terms or applicable policies;
2.Required by law, legal order, or regulatory request; or
3.Your continued use poses a security, technical, or legal risk to VidGlow or third parties.
l Effect of Termination: Upon termination, all licenses granted to you shall immediately cease. Provisions that by their nature should survive termination shall remain in full force.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDGLOW, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO USE THE SERVICE OR ANY AI OUTPUT.
11. General Provisions
l Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire legal agreement between you and VidGlow regarding the Service.
l Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
l No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
l Governing Law: These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
